You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. The term ‘Topperland Co. Ltd’, ‘Topperland’, ‘us’ or ‘we’ refers to the owner of the website whose registered office is Topperland Co. Ltd, Crossbow House, 40 Liverpool Rd, Slough SL1 4QZ. Our company registration number is 7216704 and is registered in England. The term ‘you’ refers to the user or viewer of our website.
1. Price
The prices listed on the website include courier cost and VAT, unless otherwise arranged. Topperland Co. Ltd reserves the right to adapt the prices to offset concrete cost increases (for example, salaries, material costs, and exchange rate fluctuations).
2. Payment Term
Customer order can only be accepted against debit or credit card. We accept Visa, Delta, MasterCard, Switch, Solo and Electron. Payments can also be made via your Paypal account. You must pay in full in advance when you submit your order through our customer service team. Payment will be collected at the time of finalising your order. Full payment must be received in advance before any goods are prepared or dispatched.
3. Delivery Time
Prior to the delivery we will send final product photos to the customer for approval. The delivery time is specified in the confirmation of order/contract. It may be extended due to unforeseen circumstances due to factors out of the control of Topperland. E.g. epidemic, earthquake, war etc. as well as delivery delays from our material suppliers. In any such event, Topperland Co. Ltd bears no liability but will inform you of these circumstances and arrange for delivery at the earliest period possible. Under normal circumstances the products will be shipped on time.
4. Refunds and Cancellations
As our cake toppers are made to order and personalised to your specification, orders cannot be cancelled once the item has been made or decorated and we do not offer refunds. However, we want you to be completely satisfied with every purchase that you make from us. If you are unhappy with a product for any reason please contact us immediately.
5. Order Policy
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Topperland Co. Ltd reserves the right at any time after receipt of your order to accept or decline your order for any reason. We may require additional verification or information before accepting any order.
6. Copyright and Trademark Notice
All screens appearing on this site including graphics, text, design, buttons, logos, images, and icons, as well as the selection, assembly, and arrangement, are the sole property of Topperland Co. Ltd, and are protected by UK and international copyright laws. The content on this Site is only for the purpose of shopping on this site or placing an order and for no other purpose. Any other use, including, modification, reproduction, uploading, posting, transmission, or distribution in any form or by any means without Topperland Co. Ltd's prior written permission is strictly prohibited. All software used on this Site is the sole property of Topperland Co., Ltd or those supplying the software.
Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.
7. Privacy Policy
Pictures of your toppers may be used as examples. Topperland Co., Ltd does not disclose buyer’s information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party.
Data collected by this site is used to:
- Take and fulfil customer orders
- Administer and enhance the site and service
- Only disclose information to third-parties for goods delivery purposes
8. Shipping Damage Claims
All claims for shipping damage must be filed by the recipient with Topperland Co. Ltd within 48hrs of receiving cake toppers, including sending digital photographs of the damaged product. All merchandise is carefully packaged for shipment, but in the case of damage caused by delivery, Topperland Co., Ltd will remake damaged products and ship the replacement product to the customer (where the new remake order is considered received on the date when the shipping damage claim has been recognised by Topperland Co. Ltd)
9. Guarantee
♦ Any defects in material will be promptly rectified, provided claims are made and defective parts are return shipped within 48hrs of receipt of goods for our timely examination. Other than assisting with shipping damage claims (see Shipping Damage Claims above), no additional warranties, expressed or implied, is provided by Topperland Co., Ltd.
♦ Character figurines are not intended to be portraits or exact duplicates of you or your faces. Figures are handmade and minor flaws may be expected as a result of the process. Resemblances will be based on the photos provided.
10. Limitation of liability
Except as specifically stated on our web site, under no circumstance shall neither Topperland nor any of its directors, employees or other representatives be liable to any party for damages arising out of or in connection with the use of the web site, or any other hyperlinked web site. This is a comprehensive limitation of liability that applies to all damages of any kind, including, but not limited to, compensatory; direct; indirect or consequential damages; even if Topperland has been expressly advised as to the possibility of such damages.
